I know I need a Will I just haven’t got around to doing it yet?

It’ s very easy to keep putting off making an appointment to write your Wills. In an ideal world we should all write our Wills when we have assets to pass on to someone. That could be savings, house, having a baby, a new relationship, divorce, an illness. It takes an hour of your time to take your instruction, which could provide you and your family with peace of mind knowing that your affairs are in order

Why would I need a Will?

A lot of my clients initially think this. When I die it goes to my spouse/partner then to my children if I have any. This is not always the case.

Marriage

Marriage revokes your Will.

Children

Appoint guardianship for all minor children in the event that you are no longer around to care for them.

Relationship

Moving in together but not married you should write a Will to protect your partner if anything should happen to you.

Business

If something happens to you and you are unable to run your business either you have lost capacity or on death what should you do? If you have a shareholder’s agreement, a contingency plan should be in place but if you are a sole trader what happens then? I can give your executors the powers to carry on your business should they need it.

Divorce

Once divorced your ex spouse is classed as predeceasing you in your Will and therefore their benefit no longer applies therefore you will need to write a new Will stating who you would like your estate to go to.

Property

Purchasing a new home is exciting but have you made a Will to specify who you would like to leave it to if anything happens to you?

Illness

If you lose your mental capacity who will make decisions on your behalf?

Funeral prices are continually increasing with each year. You can pay for your funeral now giving your loved ones the reassurance that they will not have to pay for your funeral in the future.

Do you own your own Business – Are you a sole trader or in a partnership?

What would happen to your business if you are no longer around or you have lost capacity?

This is a question all sole trader businesses or partnerships should ask themselves.
You should have a contingency plan in place.

Appoint Directors

In the event of your death who would look after your business? If you are a sole trader there must be a clause in your Will that will allow your executors/business trustees to carry on your business. Either close the business or appoint a new Director to run the business. If you are a partnership you should have an agreement that will allow your partner to carry on the business.

Bank Accounts

If you lose capacity then your business bank account could be frozen. Having a powers of attorney for property & finance will enable you to appoint an attorney to look after all your financial affairs if you are unable to do so.

Pay staff and suppliers

If you employ staff how would you continue to pay them if you are unable to do so. Having a Will in place to enable your executors or business trustees to make those decisions for you and having an attorney that can deal with all your financial affairs who will be able to  continue to pay your staff and suppliers.
